In Newark’s federal courthouse, Rep. LaMonica McIver’s fate now hangs between criminal indictment and constitutional principle.

Prosecutors say she assaulted ICE agents while trying to interfere with the arrest of Mayor Ras Baraka outside a detention facility.

Her lawyers insist she was doing protected congressional oversight, caught in a brief, chaotic scuffle ICE

itself helped ignite by delaying access and escalating tensions at the gate.

Judge Jamel Semper has not decided whether to dismiss the charges,

but he sharply questioned the government’s conduct, blasting “fact-free”

DHS social media posts that painted McIver and other Democrats as Antifa-linked trespassers who

“stormed” the facility. Those statements, he warned, could poison any future jury.

McIver’s team calls the case a Trump-driven attempt to

“end wokeness,” contrasting her prosecution with pardons for January 6 defendants.

Facing talk of a 17-year sentence, McIver says the fear is real — but so is her resolve to keep fighting.
